General
The following terms and conditions apply to orders placed by a customer, hereinafter referred to as “you”, with Our Kith and Kin, a company established and operating under the laws of the United States at www.ourkithandkin.org. By using our website and/or placing an order on it, you enter into agreement with Our Kith and Kin, hereinafter referred to as “me/I”, and consent to be unreservedly bound by these Terms and Conditions, having read them. Please make sure you have read and understood the Terms and Conditions before placing your order. Also, by placing an order, you declare and guarantee that you are legally capable of entering into a binding agreement with me. These Terms and Conditions may be modified without any prior notice, so I ask you to consult them regularly. The Terms and Conditions that will be applicable to your order will be those on www.ourkithandkin.org at the time you place an order.
Prices and Sales Tax
A 6% sales tax will be added during the check-out process to all orders placed online whose customer billing address is located in the state of Maryland.
Placing an Order/Conclusion of Contract
To place an order, please follow the online purchasing procedure and click on “Complete Order”. You are legally bound by your order from the moment you accept the online offer of Our Kith and Kin and the conditions thereby determined have been satisfied (once the order has been placed and payment confirmed on the website).
Order Confirmation and Delivery
You will get an immediate confirmation of an order that you have placed on your screen at the end of the checkout process. The digital product will be available for download in the Order Confirmation page. Shortly after your order is placed, you will also receive the standard order confirmation email, followed by an email containing a download link that will expire 24 hours after the purchase. If you click an expired link, I will send you a new link to the email address used for the initial purchase. If you don’t receive a confirmation email with your download link within one hour, please contact me at hello@ourkithandkin.org.
Payment
I accept payments through PayPal and Stripe, which allows you to purchase a product using a debit/credit card and Apple Pay. By clicking “Submit Payment” you are confirming that the debit/credit card is yours and the provided payment details are both valid and correct. Credit card holders are subject to validation checks and authorization by the card issuer. In the case the issuer of your payment card refuses to or does not authorize payment I will not be liable for any deny or delay of a purchase.
Refunds
I will not provide refunds for any digital downloads. Should you have any questions concerning our products, please contact me via email at hello@ourkithandkin.org prior to making any purchase.
Intellectual Property
Our Kith and Kin is the owner of the website www.ourkithandkin.org and its contents. Contents of my website are protected by intellectual property rights and remain with me. Any use of my website and its contents, including reproducing, copying or storing such content in whole or part, for commercial purposes is strictly prohibited without the express written permission of Our Kith and Kin. All downloads and their content, including licensed artwork are copyright Our Kith and Kin. All rights reserved. These products are to be used for personal non-commercial use only and may not be redistributed. Please contact me at hello@ourkithandkin.org if you suspect someone has committed copyright infringement of my website, its contents, and/or my products.
Liability
My liability with regard to any product acquired on my website is strictly limited to the purchase price of that product. I shall not accept any liability for indirect losses regardless of their origin.
While I try to ensure that all information displayed on my website is accurate and up to date, I cannot guarantee that the content of my website is free of inaccuracies or typographical errors at all times. I do not assume any liability for the consequences of incomplete or erroneous information on the website.
I cannot guarantee that colors of the products on my website will be true to life. I cannot be held responsible for variations in colors since this depends partly on the color settings of your monitor and computer.
My website may contain links to other websites maintained by third parties and beyond my reach. I cannot be held liable for content or privacy policies of such websites.
Entire Agreement
These Terms and Conditions represent the entire agreement between you and Our Kith and Kin and supersede any prior agreement, understanding or arrangement between you and Our Kith and Kin, whether in writing or oral. Both you and me represent that, in entering into this contract, neither you nor I has relied upon any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between you and me prior to such contract.
Written Communications
Applicable laws may require that some of the information I send to you should be sent in writing. When using my website, you accept that communication with me will be mainly electronic. For contractual purposes, you agree to this electronic means of communication and acknowledge that all communications that I provide to you electronically comply with any legal requirement that such communications be in writing.
Applicable Law
These terms and conditions shall be in accordance with the laws of the United States and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the courts of the United States.
